By Philippine law (Presidential Decree No. 851), all rank-and-file employees are entitled to a 13th-month pay, which is equivalent to 1/12 of their basic salary earned during the calendar year. It must be paid out on or before December 24th. Our EOR service automatically calculates and accrues this for you so there are no surprises at the end of the year.

All regular employees are legally entitled to:

  • Government contributions (SSS, PhilHealth, Pag-IBIG).

  • A minimum of 5 days of paid Service Incentive Leave (SIL) per year (though many competitive employers offer more).

  • Overtime, night differential, and holiday pay (if applicable to their role).

While both fulfill local presence requirements, their legal roles differ:

  • A Nominee Director sits on the Board of Directors of a Domestic Corporation (subsidiary) to satisfy governance and board composition requirements.

  • A Resident Agent is required for a Foreign Branch Office or Representative Office in the Philippines. Their primary role is to receive legal summons and official notices from the SEC and other government agencies on behalf of the foreign head office. 25east Corp. can provide both roles depending on your entity type.
